These terms are the contract between you and EMPTYJET L.L.C-FZ for using TripAndFly — the website, the Telegram bot, the Telegram Mini App, and Sofia. TripAndFly and EmptyJet are services of the same company. This is one contract, not two offers. By continuing from the sign-in panel on the website, or by tapping Accept in the Telegram Mini App, you accept these terms and the Privacy Policy. Sofia will not continue on Telegram until you accept these terms.

Questions about this contract: [email protected] or [email protected], or by post to the registered office. Using TripAndFly is not using a different company from EmptyJet.
2. What we are, and what we are not
Sofia is a travel secretary. Through her you can search fares that are available now, hold traveller details, pay, and receive an issued ticket. We operate the service. We are not a carrier, not an airline, not a payment institution, and not a bank. We do not issue e-money as a regulated product. We do not sell you the seat; the airline does, through a ticketing gateway.
Once a ticket is issued, the contract of carriage is between you and the validating airline (and any handling carrier). Their conditions of carriage, fare rules and notices apply to the journey. We keep a record of what was issued so we can show it to you and so we can evidence fulfilment.
3. Who may use the service
You must be 18 or over to open an account. That is a condition of use. We do not check your age against a passport or other identity document when you sign in. If you are under 18, do not open an account. If we learn that an account belongs to a person under 18, we will close it and delete what we can, subject to the retention rules in the Privacy Policy.
A person aged 18 or over may add a child as a travelling companion where they have parental responsibility or another lawful authority to do so. That does not give the child a login. The child’s travel data is used only to issue the ticket the adult asked for.
4. What the service includes
The service includes, as built today:
- searching fares that are available now through a contracted ticketing gateway (TBO);
- holding a draft itinerary and traveller details while you decide;
- holding an unpaid order for a limited time, then marking it expired;
- taking payment and asking the gateway to issue the ticket;
- showing issued tickets in your account;
- an internal wallet balance and a watch-only cryptocurrency deposit path;
- a conversation with Sofia on the website, in the Telegram bot, and in the Telegram Mini App.
Sofia may look up public facts (border formalities, airport information) for a short time. Those results are cached for a few hours. A conversation may be read by our ticketing desk when issuing, correcting or investigating a booking requires it. An internal quality layer may review a conversation to correct Sofia; stored quality notes are not written in the ordinary configuration.
The service is a booking assistant. It is not a guarantee that a particular fare will still be there when you pay, and it is not the airline’s own sales channel.
Sofia is powered by generative artificial intelligence. She is there to help you find and book travel. From time to time a reply may be incomplete, out of date, or incorrect. Treat her answers as assistance, not as a verified statement. Check fares, times, documents and entry rules before you rely on them.
5. Your account
You may sign in with Google, Apple, an email sign-in link, or Telegram. The email link is sent by Firebase Authentication (Google) to the address you typed. We do not operate our own mail server for that message. We do not receive your Google or Apple password. Telegram sign-in uses Telegram’s signed payload. On Telegram you accept these terms and the Privacy Policy in the Mini App before Sofia will continue.
You may link a website account to a Telegram identity. That merge combines profiles, travellers, tickets and wallet balances into one surviving account. The absorbed account is marked merged. Do not link an account that is not yours.
You must keep your sign-in method under your control. You are responsible for activity on the account after you have signed in, except where we failed to take reasonable care.
6. Quotes, holds and unpaid orders
A fare shown to you is an offer from the gateway as it stood at that moment. A live quote is ordinarily held for about twenty minutes. After that the price and the seats may have changed. Asking us to search again is a new request, not a continuation of the old quote.
An unpaid order stays adjustable for twelve hours from when it was opened. After that it is marked expired when the account is next opened. The order row may remain on file for diagnostics and abuse review. Expiry is not a ticket and not a refund.
A quote is not a ticket. No seat is yours until the gateway confirms issue and we show you the passenger name record or ticket numbers.
7. Payment
You may pay with a card through Stripe, from your wallet balance, or by a cryptocurrency transfer to a deposit address we derive for that invoice. Card numbers, expiry dates and security codes are entered in a Stripe frame. They do not touch our servers. We receive a reference, an amount, a currency and a status. Stripe’s terms and privacy notice apply to the card charge.
The wallet is an internal US-dollar ledger. It is not a bank account and it is not e-money issued as a regulated product. It exists so you can pay a fare without repeating a card or chain transfer for every booking. Top-ups and ticket purchases are sealed lines.
Cryptocurrency deposits use watch-only extended public keys. We do not hold the corresponding private keys on the service. We watch a derived address on a public chain (through services such as TronGrid and Etherscan). A public blockchain is a public ledger. Amounts written to it cannot be reversed by us. Exchange rates and coin prices come from public sources (exchangerate-api and CoinGecko). Those figures can move while a deposit is in flight; the invoice states the allowance we will accept.
A payment that succeeds is applied to the order or the top-up it was taken for. A failed, cancelled or expired charge does not hold a fare. Refunds of a card charge, where they are due, are made through Stripe to the same card path. A change or refund of an issued ticket is a request to the airline, subject to the fare rules, not a right against our wallet.
8. Tickets and the airline’s contract
When you ask us to issue, we send the passenger payload the carrier requires — legal name, date of birth, sex, nationality, document details, and a contact the airline can use — through the gateway. The gateway returns a booking identifier, a passenger name record and ticket numbers. We store those encrypted and show them on the tickets page.
The contract of carriage is the airline’s. Delay, cancellation, denied boarding, baggage, visas and entry are matters for the airline and the authorities, not a promise we make about the journey. We will pass a change or refund request where the desk can do that work; we cannot delete a passenger name record from the airline’s system by erasing your conversation with us.
You must give accurate passenger data. A ticket issued on the names and documents you supplied is fulfilment of our part. A mismatch at the gate is not a defect in the service.
9. Travel documents
You may type the fields or photograph a passport or national identity card so Sofia can read them. The photograph is used only to extract those fields and is then discarded. We may keep a digest of the image and the extracted fields so a later upload can be recognised as the same page. We do not keep the pixels. You may refuse the camera and type instead.
Do not send a document that is not yours, or a child’s document, unless you have the right to do so. We do not use a photograph for biometric identification.
10. Sofia’s memory and /forget
Sofia may keep memories so the next conversation does not start from nothing — preferences, people, places, routines. Conversation history remains until you erase it or the account is closed. Attachment bytes, voice recordings and chat photographs are not kept after the turn that used them.
Erasing memory from the account, or sending /forget on Telegram, deletes conversations, memories, quality notes attached to you, and cached search drafts. It does not delete the account, travellers, documents, orders, tickets, the wallet, audit entries, or issued-ticket records. /forget is not closure of the account.
11. What you must not do
You must not:
- open an account if you are under 18;
- give us another person’s travel data without the authority to do so;
- use a stolen card, a payment you cannot honour, or a method intended to reverse a completed charge without grounds;
- interfere with the service, scrape it beyond ordinary use, or attempt to reach systems or data that are not yours;
- use the service to commit fraud, to evade a sanction, or to book travel you are not entitled to take;
- abuse Sofia, the desk, or other customers.
We may suspend or close an account, refuse a search or an issue, or reverse a wallet credit where we reasonably believe this section has been broken, or where the law requires it. Blocking an account for abuse is a human decision of the operator.
12. Responsibility
We will take reasonable care in operating the service: searching, holding what you asked us to hold, sending the payload you confirmed, and showing you what the gateway returned. We do not promise that a fare will remain available, that an airline will operate the journey, or that a public chain, Telegram, Google, Apple or Stripe will be uninterrupted.
Nothing in these terms excludes or limits liability that applicable law does not allow us to exclude or limit. That includes liability for death or personal injury caused by our negligence, and for fraud or fraudulent misrepresentation. If you are a consumer, you also keep any mandatory rights the law of your country of residence gives you, including — if you live in the European Union — the obligatory protections of that country’s consumer law.
Subject to that, we are not liable for the airline’s performance of the journey, for a fare that disappeared before issue, for a delay or failure of a third-party system named in the Privacy Policy, or for a public blockchain. For other loss arising from our failure to take reasonable care, our liability is limited to the amount you paid us for the booking or top-up concerned. We are not liable for loss of profit, or for loss that was not reasonably foreseeable, except where a consumer statute requires otherwise.
Sofia’s replies are generated by artificial intelligence and may contain errors. Except where applicable law does not allow us to exclude it, we are not responsible for loss that arises solely because you relied on a Sofia reply that later proved inaccurate. This does not reduce our duty to operate the booking service with reasonable care, as set out above, or our record of a ticket once the gateway has confirmed issue.
If you use the service as a consumer in your own country, these terms do not take away a mandatory right that country’s law gives you. See section 14.
13. Stopping and closing
You may stop using the service at any time. You may sign out, which ends the session. You may erase Sofia’s memory as described in section 10.
There is no button in the product that closes the account. To close the account, write to [email protected] or [email protected], or use emptyjet.com/dsar. We will need to verify that the request is yours. Closing the account is not /forget. Issued tickets, passenger name records, the wallet ledger and audit entries are kept as the Privacy Policy explains, because the law or a claim still requires them.
We may stop providing the service, or a part of it, with notice on the website or through Telegram where we still have a channel to you. An issued ticket remains a record with the airline even if the assistant is withdrawn.
14. Governing law
These terms are governed by the laws of the United Arab Emirates as applicable in the Emirate of Dubai. The United Nations Convention on Contracts for the International Sale of Goods is excluded. The courts of Dubai have non-exclusive jurisdiction, which means that if you are a consumer you may also bring proceedings in the courts of the country where you live, and you do not lose the mandatory protections of that country’s law. If your habitual residence is in the European Union, you additionally keep the protection of the obligatory provisions of the law of that country.
Nothing here limits a right you have to complain to a supervisory authority or to bring a claim a statute gives you.
15. Language
These terms are published in several languages so that you can read them. The English text is the original. The other languages are translations. If a translation differs from the English text, the English text prevails, except where a mandatory law of your country requires that the translation shown to you is binding.
16. The Privacy Policy
How we process personal data is stated in the Privacy Policy, not in these terms. If these terms and that notice conflict on a privacy question, the notice prevails for that question. On every other question these terms prevail.
17. Changes
We will change these terms when the service changes, or when the law requires a clearer statement. The date at the head of the page is the date of the current text. A material change is given a new version stamp. At sign-in we record the version that was current then.
There is no in-product screen that asks you to accept a later version. Continuing to use the service after a published change is how the updated terms apply to use that continues. If a change requires a new consent, we will not start that processing until we have it.
